Terms and Conditions of Sale
These general terms and conditions of sale (hereinafter the « GTCS ») govern the sale of licences for the Senso MCP extensions and associated services on the sensomcp.com website. They apply to all orders, whether placed by a consumer or a business customer.
Article 1 — Purpose and scope
These GTCS define the rights and obligations of the parties in connection with the online sale of licences for Joomla extensions published under the Senso MCP brand, together with the associated update and support services.
Every order entails unconditional acceptance of these GTCS. The customer declares that they have read and accepted them by ticking the box provided for this purpose before confirming their order. The applicable GTCS are those in force on the date the order is placed.
The publisher reserves the right to adapt or amend these GTCS at any time; the GTCS applicable to an order are those accepted when that order was placed.

Article 3 — Definitions
- Publisher: Sensomedia, seller of the licences and provider of the services.
- Customer: any individual or legal entity placing an order. “Consumer” means a person acting within the meaning of the introductory article of the French Consumer Code; “business customer” means a person acting in the course of their business activities.
- Extension: digital content (a component, plugin or module for Joomla) offered by the publisher.
- Offer: a commercial access level (Free, Pro, Premium, Add-on) determining the extensions and services available.
- Licence: the right, for a fixed period, to download one or more extensions, receive their updates and benefit from support, subject to the number of authorised domains.
- Download ID: the personal key linking a customer's site to their licences for installation and updates.
Article 4 — Offers, licences and services
The publisher offers a free plan (basic pack) and paid plans (Pro, Premium, Add-on) providing access to additional extensions. Details of the extensions included in each offer are shown on the website at the time of ordering.
The paid licence is granted for a fixed period (generally twelve months, as specified when the order is placed) and for the number of domains indicated at the time of purchase. During this period, it entitles the customer to:
- download the extensions included in the subscribed offer;
- receive updates released by the publisher;
- receive support in accordance with the terms of Article 13.
The extension code is also distributed under a free software licence (see Article 11). The expiry of a paid licence never results in an extension that has already been installed being blocked; it only suspends downloads, updates and support until the licence is renewed.
Article 5 — Orders and customer account
Orders are placed online at sensomcp.com. The customer selects an offer, checks the details of their order and confirms it after accepting these GTCS. Confirmation of the order constitutes conclusion of the contract.
A customer area is created at the time of the first purchase; it allows customers to track orders, manage their licences and Download ID, and open support tickets. The customer is responsible for the accuracy of the information provided and for keeping their login details confidential.
The publisher reserves the right to refuse or cancel any order that appears abnormal or fraudulent, or in the event of a previous unresolved dispute.
Article 6 — Prices
Prices are shown on the website in euros. Unless otherwise stated, they are exclusive of taxes; where applicable, the relevant VAT is added and itemised before the order is confirmed.
The prices applicable are those displayed when the order is placed. The publisher may change its prices at any time, without affecting orders that have already been confirmed.
Article 7 — Payment
Payment is due when the order is placed. It is made using the methods offered on the website (in particular, bank card and/or other payment providers indicated during checkout).
Transactions are processed by secure payment providers. The publisher does not have access to the customer's banking details, which do not pass through its servers. The order is only definitively recorded once payment has been confirmed.
Article 8 — Provision and Download ID
As the extensions constitute digital content, they are made available by download, without a physical medium. Once payment has been confirmed, the customer can access their downloads and Download ID from their customer area.
The Download ID is strictly personal. The customer undertakes not to disclose it to third parties or use it beyond the number of domains authorised by their licence.
Article 9 — Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, consumers are generally entitled to a fourteen (14)-day period in which to exercise their right of withdrawal.
However, pursuant to Article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised in respect of the supply of digital content not provided on a physical medium where performance has begun, after the consumer has given their prior express consent and expressly waived their right of withdrawal.
By confirming their order, the consumer: (i) expressly requests immediate performance of the service (access to downloads and updates as soon as payment is confirmed); and (ii) acknowledges that they lose their right of withdrawal as soon as performance begins. In the absence of such consent, or while the download has not begun, the right of withdrawal may be exercised under the ordinary legal conditions.
Business customers do not benefit from the right of withdrawal provided for by the French Consumer Code.
Article 10 — Term, renewal and termination
The paid licence takes effect when payment is confirmed and remains in force for the period specified when the order is placed. At the end of that period, it may be renewed, where applicable at a preferential rate, to extend access to updates and support.
Unless an automatic renewal has been expressly subscribed to and clearly indicated when the order was placed, the licence is not tacitly renewed. In the event of automatic renewal, the customer is informed and may disable it from their customer area before the expiry date, in accordance with the conditions laid down by law.
Failure to renew does not affect extensions that have already been installed; it only ends access to downloads, updates and support at the expiry date.
Article 11 — Software licence (GPL)
The code of the Senso MCP extensions is distributed under the GNU General Public License version 2 or later (GPLv2 and subsequent versions). Under the terms of this licence, customers are free to use, study, modify and redistribute the code.
Purchasing an offer does not restrict the freedoms granted by the GPL licence in respect of the code obtained: it funds downloads, automatic updates and support for the duration of the licence. Non-software elements (brand, logos, visuals and documentation) remain protected under the terms of Article 15.
Article 12 — Statutory warranties
Independently of any commercial warranty, consumers benefit from the following statutory warranties:
- the statutory warranty of conformity for digital content and services (Articles L217-3 et seq. of the French Consumer Code), which notably allows them to obtain the conformity of the digital content;
- the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).
To enforce these warranties, the customer contacts the publisher via their customer area. As software may inherently contain anomalies, the publisher undertakes to remedy, within a reasonable period, any non-conformities reported to it during the term of the licence.
Article 13 — Support
Support is provided for the duration of the licence's validity via the customer area, by means of tickets. It covers the installation, configuration and operation of the extensions. It does not include bespoke services, specific development, or assistance with environments or third-party extensions unrelated to Senso MCP, unless otherwise agreed.
Article 14 — Liability
The publisher takes reasonable steps to ensure the availability of the website and the quality of the extensions. However, it cannot be held liable:
- for damage resulting from misuse, modification of the code by the customer, or incompatibility with an environment, extension or third-party service;
- for data loss or unavailability attributable to the customer's hosting or to force majeure;
- for indirect damage (loss of business, turnover, customers or data).
It is the customer's responsibility to make regular backups of their site before any installation or update. These limitations do not apply in the event of gross negligence or wilful misconduct, nor may they exclude statutory warranties owed to consumers. To the extent permitted by law, the publisher's liability is capped at the amount actually paid by the customer for the licence concerned.
Article 15 — Intellectual property
The “Senso MCP” brand, logos, visuals, texts and documentation on the website are protected by intellectual property law and remain the property of the publisher or their respective owners. The extension code is governed by the GPL licence (Article 11). The other brands mentioned (Joomla, Claude, YOOtheme, etc.) belong to their respective owners.
Article 16 — Personal data
Personal data collected when placing an order and managing an account is processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act. This data is necessary for processing orders and managing licences and support.
The Customer has the right to access, rectify, erase, object to the processing of, restrict the processing of and obtain the portability of their data, which they may exercise by contacting the publisher. Detailed information is provided in the website’s privacy policy.
Article 17 — Force majeure
The publisher shall not be held liable for any failure to perform resulting from force majeure within the meaning of Article 1218 of the French Civil Code and applicable case law.
Article 18 — Applicable law and dispute resolution
These T&Cs are governed by French law.
In the event of a dispute between the Customer and the company, the parties shall endeavour to resolve it amicably (the Customer shall submit a written complaint to the professional or, where applicable, to the professional’s Customer Relations Department).
If no amicable agreement is reached or if the professional fails to respond within a reasonable period of one (1) month, a consumer Customer within the meaning of Article L.612-2 of the French Consumer Code may, if the disagreement persists, refer the matter free of charge to the competent mediator listed by the Commission for the Assessment and Monitoring of Consumer Mediation pursuant to Article L.615-1 of the French Consumer Code, namely:
La Société Médiation Professionnelle
https://www.mediateur-consommation-smp.fr
Alteritae 5 rue Salvaing 12000 Rodez
In the absence of an amicable resolution, the French courts shall have jurisdiction. In proceedings against a professional, jurisdiction is assigned to the courts of the district in which the publisher’s registered office is located; in proceedings involving a consumer, the statutory rules on jurisdiction shall continue to apply.
Article 19 — Amendments to the T&Cs
The publisher may amend these T&Cs at any time. The applicable T&Cs are those in force and accepted on the date the order is placed. The current version is permanently available on the website.
Article 20 — Miscellaneous provisions
If any provision of these T&Cs is declared null and void or unenforceable, the remaining provisions shall remain in full force and effect. The publisher’s failure to rely on any provision shall not constitute a waiver of that provision.
